SURPRISE, AZ (3TV/CBS 5) -- John Lagerwey says it is time for new window treatments.

"And this one over here, you can't get down and that one has a couple of panels missing, and one of them is kinked," explained John. 

Since John and his wife Brenda were in the market to replace their worn-out blinds with shutters inside their Surprise home, they looked around and came across a company called Arizona Custom Shutters and Blinds.

"We called them and a salesman came out, brought a couple of samples of shutters, went through and measured all the windows, and told us how much it would be. We said okay, we would do that," said John. 

Keep in mind, this all happened last April with a salesman by the name of Jason Clark. After taking a few measurements, Clark claimed he could have all shutters completed within 5 weeks. He just needed a down payment.

"$6,000 was the total for complete job installed and $3,000 what we gave him down," said John. 

John says things turned a little weird when Clark told him to make that $3,000 check out to his name and not the company's name. Adding to the peculiar transaction, look at the invoice Clark handed over. There's no company name, no address. Just not a lot of information. Still, John wrote out the check.

"When you made the check out to a name of a person and not the name of a company, did any bells go off in your head like this is weird?" we asked John. "We were too trusting, we've never been scammed or anything before, so we didn't think about it at the time," said John.

Well, it's been more than 5 months and John's shutters never have arrived. So, John contacted 3 On Your Side. "I'd like to see if you could get these guys to give me a refund," said John. 

3 On Your Side got involved and we discovered Clark has a bit of a past.

In fact, the Arizona Registrar of Contractors tells us that Clark pled guilty last year to theft for doing the exact same thing to a Buckeye homeowner. We tried getting a hold of Clark, including going to an address listed on state paperwork, but we were told he doesn't live there.

However, we managed to get a hold of Clark on the phone where he gave us all kinds of excuses for disappearing with John's $3,000.

Still, when 3 On Your Side told Clark that he should return John's money, he agreed and said he needed a little time. Well, as far 3 On Your Side and John are concerned, time is running out.

We asked John, "are you done waiting?" He replied, "I'd like to just get my money back and go somewhere else."
