This story is regarding my parents, Dan Demarbiex 61 and Rose Demarbiex 59. My dad was hospitalized 12/25/2008 due to pancreatitis. He remained in the hospital for over a week before he was released. During his hospital stay it was also determined that he had an aortic aneurysm that needed repair, however he is diabetic and his sugar levels were too high and made surgery life threatening. My dad was on disability from 12/25/2008 - 4/1/2009, during this time he recovered from the pancreatitus, got his sugar levels under control and had surgery to repair the aortic aneurysm. It was during this time he contacted Chase Home Finance LLC. to enter the Making Home Affordable program due to his decrease in income due to his health problems and disability. Chase granted a forbearance for 3 months, which supposedly within the 3 months Chase would finalize a modification. His mortgage payment was reduced from $2555.39 to $2196. My dad made the forbearance payments in June, July, August, September and October. Each month he called Chase to see if the modification was finalized, each time the representative advised him they were still working on it and to keep making the forbearance payment which he did until October. In October he went to the NACA save the dream tour in Phx in hopes of finalizing his modification, Chase proposed a MHA modification via NACA of $2270 even though his financials showed he could only afford $1500. He made these payments in November and December. He made the MHA payments proposed by Chase of $2270 in November and December. Yesterday he sent his January payment for the full amount of $2555.39 because the stress of this whole process and lack of follow through on the part of Chase has made him very sick. Today he discovered that his house is being foreclosed and auctioned at trustees sale on 4/5/2010 @ 10:00am by Tiffany & Bosco, Attorneys at Law, yet he has never received any letter of foreclosure from Chase, nor has he ever missed a payment, he made all forbearance and Making Home Affordable payments approved by Chase. During this whole process his health problems became more serious due to the stress, he had a defibulator implanted in his chest because his heart was only functioning at 10% capacity. My dad has been talking to Chase for the last week to try to pay all past amounts due from the forbearance and to have them correct his credit and today Chase tells him his house is being sold from underneath him. Please help him, he has been in constant contact with Chase and paid the payments Chase agreed to, yet Chase decided to foreclose on his home with only $1600 outstanding (from reduced forbearance/MHA payments) without ever giving him any kind of notice. Please help him, this is wrong of Chase to treat homeowners like this, especially ones who follow all the rules and don't ignore the bank.
