Retrial date set for Ariz. woman charged in son's death

PHOENIX (AP) -- A Sept. 30 retrial has been set for an Arizona woman whose conviction in the murder of her 4-year-old son was overturned by an appeals court.

The judge overseeing the retrial of Debra Jean Milke on Wednesday also set an Aug. 1 hearing to consider Milke's request to be released on bond while she waits to be tried on charges that she had a part in the 1989 shooting death of her son Christopher.

An appeals court that tossed out Milke's conviction in March had ruled prosecutors failed to disclose a history of misconduct by a now-retired Phoenix detective who claims she confessed to the crime.

Milke has disputed that and an Aug. 30 hearing also has been set to consider an upcoming request by Milke's lawyer to have the detective's claim thrown out.

Authorities say in December of 1989, Milke dressed her son Christopher in his favorite outfit and told him he was going to see Santa Claus at a mall. The child was taken into the desert by two men and fatally shot.
