MESA, AZ (3TV/CBS 5) -

A Republican lawmaker is pushing to make stealing an American flag a felony.

Although the legislative session doesn't start until next month, Sen. John Kavanagh (R-Fountain Hills) filed his bill this week.

He's proposing to make stealing the Stars and Stripes a class 6 felony, which carries stiffer penalties and fines.

Under current law, any theft under $1,000 is a class 1 misdemeanor, with two exceptions.

Stealing a gun or an animal to use for fighting are considered class 6 felonies.

Kavanagh says he got the idea after talking with someone who had their flag stolen from their house.

Should the bill become law, it would only apply to personal flags and not those sold at retail stores.
