Flakes say animal cruelty charges unwarranted

PHOENIX (AP) -- A son of U.S. Sen. Jeff Flake and the son's wife say animal cruelty charges against them are unwarranted.

Austin Flake and Logan Flake are asking a judge to remand the case to the grand jury for a new finding of probable cause. Their attorney wrote in a motion filed Tuesday in Maricopa County Superior Court that the indictment was based on false and misleading testimony presented by the sheriff's office.

County officials declined comment.

The Flakes were taking care of 21 dogs that died at a boarding facility in Gilbert this summer while Logan Flake's parents, who owned the facility, were away.

The parents have said the dogs chewed through the air conditioner's power cord, leaving the animals in sweltering heat after the Flakes left for the night.
