Teenager facing sexual abuse charges for hit below the belt

PHOENIX -- A teenager is facing sexual abuse charges for hitting another teenager in the groin while they were both inmates at the juvenile corrections facility in Phoenix.
Jacob Gietler, 18, punched the other inmate on June 14, when he was 17. Police said he admitted to hitting the other teen and that they have evidence on video, but they waited to arrest Gietler until his 18th birthday.
Criminal defense attorney Dwane Cates said that the delay in arrest and the charges themselves may be excessive.
"You can't charge somebody with a sex crime unless there's some sort of sexual intent," Cates said. "It sounds like there may have been a fight, but it doesn't sound like there was any kind of sexual intent."
Gietler will have to register as a sex offender if he is convicted.
