Phoenix man accused of driving drunk with child in vehicle

PEORIA, Ariz. -- A Phoenix couple have been arrested for allegedly putting their daughter's life at risk.

According to court documents, Fernando Marin-Garcia, 41, struck two vehicles at Happy Valley Road and Lake Pleasant Parkway in Peoria Saturday night. He then drove westbound in the eastbound lanes before stopping at 119th Avenue.

Garcia had his wife, Emilia Rivera Estrada, and their 6-year-old daughter in his truck. Police said Estrada had placed the child in the vehicle.

The girl told police that "she did not want to get in the vehicle with her father because she felt she was going to die," according to court records.

Police said both Garcia and Estrada showed signs of intoxication and preliminary breath tests showed they both were over the legal limit.

Garcia faces one count each of aggravated DUI, reckless driving, leaving the scene of an accident and attempted child abuse. Estrada, 37, faces one count of child abuse.
