SURPRISE, Ariz. -- For the second time in as many weeks in the Valley, an investigation is underway into an 18-year-old accused of having sex with young girls.
Surprise police Lt. John Bacon says their department received information on Sunday about a pair of underage girls who say they had sex with an 18-year-old fellow student at their public high school.
The girls, who were initially reported to be 14, allegedly participated willingly in the sexual acts. However, under state law, girls that young cannot legally consent.
The Arizona Revised Statue reads, in part: “…if the victim is fifteen, sixteen or seventeen years of age, the defendant is under nineteen years of age or attending high school and is no more than twenty-four months older than the victim and the conduct is consensual.”
Bacon says a large portion of their investigation will center on how old the girls were at the time of the alleged sexual encounters.
According to police, there are other girls as well, ranging in age from 15-17, who say they also had sex with the 18 year old.
Police say if they receive information that the girls were not of consenting age or if they did not give consent, the 18 year old will face charges.
Last week, a San Tan Valley teen was arrested on 25 charges related to sex crimes. The Pinal County Sheriff's Office called Tyler Kost a "serial sex offender and rapist" after 18 alleged underage victims came forward.
