Arpaio critic's suit over 2008 arrest dismissed

PHOENIX (AP) -- A lawsuit by a critic of Maricopa County Sheriff Joe Arpaio over the critic's disorderly conduct and trespassing arrest in 2008 was dismissed on the day the trial was to start.

U.S. District Judge District Roslyn Silver says in an order Tuesday that Randy Parraz was dismissing the case.

Parraz didn't return a call seeking comment.

The lawsuit alleged Parraz was maliciously prosecuted on trumped up charges after a spat with sheriff's deputies over whether he had a right to be on public property during a county Board of Supervisors meeting. A judge dismissed the charges.

Parraz was a leader in the unsuccessful effort earlier this year to force a recall election against Arpaio.

Arpaio says Parraz must have figured a jury would have seen through his allegations.

My decision to dismiss the lawsuit against Maricopa County and named Sheriff Deputies stemming from my unlawful arrest in 2008 involved a number of factors, circumstances and legal considerations.  

The circumstances, factors and legal considerations that caused me to make this very difficult decision shall remain confidential.

As you can imagine, no one was more disappointed about the final outcome of this case than me.

I wish to express my gratitude and appreciation for all the words of support and encouragement I have received from community leaders, friends and colleagues. 

Unfortunately Sheriff Arpaio and his media specialists have once again engaged in retaliatory behavior by issuing a press release that attacks me and inaccurately describes what actually occurred yesterday in court.

Finally, I invite Sheriff Arpaio, County leaders and members of the Maricopa County Sheriff's Office to pursue practices and policies that serve, protect and defend the Constitution of the United States and all those who reside in Maricopa County.
