NOGALES, Ariz. -- The Arizona woman accused of smuggling drugs in Mexico was not released from a Nogales women's prison Tuesday as her family had hoped.

Yanira Maldonado, 41, was taken into custody last Wednesday after a bus she was on with her husband was stopped in Hermosillo, Mexico.

Federales said they found marijuana under her seat.

Since her arrest her husband, Gary Maldonado, has been in Mexico fighting for her release.

The family suspects she was framed.

Yanira is a mother and practicing Mormon and her family says she doesn't drink or smoke or participate in criminal activity.

Gary spoke to 3TV as he crossed back from Mexico into the United States after a full day of court proceedings. He said he was "hopeful" his wife would be released this week.

Gary's wife speaks Spanish and was born in Mexico, but she's been in the states for more than 20 years.

Witnesses from the bus ride testified Tuesday on Maldonado's behalf that she did not bring drugs onto the bus.

The family will return to court Wednesday.

The judge could render a decision by Friday at 6 p.m.
