TEMPE, Ariz. -- A picture of a baby doing a keg stand at a tailgate party in Tempe caused a lot of outrage, but an attorney said it's not what it appears.

On Monday night, gossip website TheDirty.com posted a picture of a man holding a baby upside down over a beer keg. The tap appears to be touching the child's mouth.

The website's creator, Nik Richie, said the person who submitted the photo claims it was taken at a tailgate party outside an Arizona State University football game.

"As soon as I saw it, I was in shock," Richie said. "At first I didn't believe it. I do ask that the parents come forward and make an apology."

On Tuesday, university officials said ASU police were looking into the posted photo.

The attorney representing the child's parents assures that the baby was not drinking alcohol and said the picture was staged.

Mark Parker said it was actually taken for a website that hasn't launched yet. She wouldn't name the website but said it's meant to see how people would react to certain situations.
