PHOENIX -- A 10-year-old boy has passed away following a car accident on Tuesday evening.

Phoenix Police said Damian Figueroa died on Wednesday due to injuries sustained in the crash.

Figueroa was hospitalized after a 66-year-old male traveling southbound on 45th Avenue failed to stop at the sign on Indian School Road.

The man’s car wound up colliding with a vehicle that was being driven by Figueroa’s father. Figueroa’s 7-year-old brother was also in the vehicle. All three passengers were wearing safety restraints.

Figueroa, who was riding in the front passenger seat, was hospitalized with very critical injuries. His father and brother did not suffer life-threatening injuries.

The driver of the other vehicle also had to be hospitalized with serious injuries. He was evaluated and found to have not been impaired at the time of the crash.

The accident remains under investigation. No charges have been reported.
