PHOENIX (AP) -- A judge is refusing to block a legislative hearing on an ethics complaint against Sen. Scott Bundgaard stemming from a domestic violence incident involving the Peoria Republican.

The ruling Tuesday by Judge John Buttrick of Maricopa County Superior Court says court intervention is barred because the Arizona Constitution grants the Legislature the authority to police itself.

Bundgaard's attorney had argued that the Senate Ethics Committee's process is flawed and that Bundgaard cannot get a fair hearing.

The Senate Ethics Committee hearing is scheduled for this week, and the case could result in a reprimand, a formal censure or even Bungaard's ouster from the Legislature.
