TUCSON, Ariz. -- Five Arizona death row inmates are appealing a federal court decision that Arizona's execution process does not violate their constitutional rights.
Attorneys for the five inmates filed a lawsuit claiming the state has not followed legal protocol for lethal injections; allegedly using unqualified personnel to perform the injections under a sheet, away from the view of witnesses.
A U.S. District judge dismissed the lawsuit, saying there's no evidence the practice violates inmates' rights to due process or protection from cruel and unusual punishment.
That ruling will now be contested in the Ninth Circuit Court of Appeals.
