Scottsdale attorney arrested in deadly road rage shooting

SCOTTSDALE, Ariz. -- A Scottsdale criminal defense attorney has been arrested in a deadly road rage incident Thursday night in Scottsdale.

Police say shortly after 7pm two men were driving north on Pima Road near Pinnacle Peak Road  when they pulled over into the back lot of a CVS Pharmacy.

The drivers, one in a Toyota FJ, the other in a Honda Ridgeline, parked near the loading dock.      59-year old David Ross Appleton told authorities Paul Pearson was tailgating him. The men pulled into the CVS parking lot where Appleton claimed Pearson walked up to his open window and began choking him. Appleton said he pointed his revolver at Pearson in an effort for him to let go. When he didn't stop, Appleton allegedly pulled the trigger striking Pearson in the chest.

Police say Appleton dialed 911 to report he had just shot someone. Upon arrival police found a 50-year old man with a gunshot wound. Pearson was rushed to SHC-Osborn where he died just after 8pm.

As police worked the case into the early morning hours, through physical evidence and witness interviews, detectives found inconsistencies in Appleton's story. As a result, Appleton was arrested  for 1-count of 2nd degree murder and transported to the MCSO 4th avenue jail.
