TUCSON, Ariz. -- A federal appeals court is considering an emergency motion that would keep Tucson mass shooting suspect Jared Loughner from being sent back to a Missouri prison.
Loughner's lawyers filed the motion Friday night.
Earlier this week judge Larry Burns extended the suspected gunman's commitment to the Missouri facility by four months.
But the defense says Loughner's transportation and commitment back to the prison will cause him "irreparable harm."
The court has until Monday evening to respond.
