Tucson SWAT officers who killed former Marine during raid cleared

TUCSON, Ariz. -- The five SWAT team members who shot and killed Jose Guerena in a raid May 5 have been cleared of any charges.

The Pima County attorney's office reviewed the case to see if the SWAT team broke the law in killing guerena.

"The use of deady force by the SWAT team members was reasonable and justified under the law," Chief Criminal Deputy David Berkman wrote in a letter to the Pima County sheriff.

The prosecutor also wrote that the autopsy reveals Guerena was shot from the front, and damage to his rifle indicates he was likely pointing it at the officers when they shot him.
