Vehicle found, but suspects involved in fatal shooting still outstanding

PHOENIX – A man was killed as he tried to stop suspects from robbing his uncle’s store in Phoenix.

Police say the uncle and nephew were inside Yerberia San Simon near Seventh Avenue and Hatcher Road at about 3 p.m. Thursday.

The 25-year-old nephew, identifed as Oswaldo V. Rodriguez, stepped out of the establishment with one of the suspects to take a look at their truck that had a "for sale" sign on the back window.

In the meantime, the second suspect allegedly entered the store and robbed the victim's uncle of money and other personal items.

As the nephew returned to the store, he noticed what had transpired and got into a physical struggle with one of the suspects and was shot in the head. He was pronounced dead a short time later.

“All I really heard was two pops, bang bang and then that was it. Then we walked out and the guy was down there laying down with blood coming out of his head,” a person who works next door to the business said.

Police say the suspects fled the scene in a blue 1999 Chevy Silverado truck with license plate AKT6561. The truck had the for sale sign and a large Chevy emblem on the back window. The truck was found on Saturday, but as of Sunday the suspects are still outstanding.

The suspects are described as two Hispanic men. One was between 40 and 50 years old and had long black hair and two missing front teeth. The second suspect is described as a man between 60 and 70 years old, 5 feet 8 inches tall with a thin build.
