Jury fails to reach verdict in neighbor-shooting trialPosted: Updated:
PHOENIX -- A jury failed to reach a verdict in the trial of a Phoenix man charged with fatally shooting a neighbor.
Judge Susan Brnovich declared a mistrial Wednesday in the case against Gary Thomas Kelley, 50.
Kelley was charged with one count of murder and two counts of aggravated assault in the death of Juan Varela, 44.
Police said Kelley and Varela lived two houses apart near Seventh Street and Southern Avenue and had gotten into altercations during the past several years.
The two men argued on May 6 with Kelley reportedly using racial slurs prior to shooting Varela.
The next court date is set for Feb. 17.
