Arrest warrant for Phoenix police officer withdrawnPosted: Updated:
PHOENIX -- A Phoenix police officer failed to show up for a court hearing Friday morning and a warrant was issued for his arrest, however there reportedly was a scheduling error with his lawyer.
In January, Gilbert police found Officer Seth Castillo passed out in his car.
Police said the off-duty officer was driving at more than twice the legal alcohol limit when he went right through a stop sign and fell asleep in the middle of a Gilbert street.
Investigators said Castillo was slumped over the steering wheel of a black Jeep Cherokee with the car still in drive.
Gilbert police said Castillo was combative and an officer was forced to use a stun gun.
Castillo is charged with extreme DUI and interfering with a police officer.
He has filed a $500,000 claim against the city of Gilbert, saying officers used excessive force and violated his civil rights.
