12-Year-old to be tried as juvenile in mom's deathPosted: Updated:
SIERRA VISTA, Ariz. (AP) -- A judge says a 12-year-old Douglas boy accused of fatally shooting his mother will not be tried as an adult.
Cochise County Superior Court Judge James Conlogue made the ruling on Monday after listening to testimony from a defense psychiatrist .
The boy was arrested in August after he allegedly shot 34-year-old Sara Madrid multiple times after an argument.
Deputy Cochise County Attorney Gregory Johnson wanted the boy tried as an adult, calling the shooting "first-degree, premeditated murder."
Defense attorney Sanford Edelman called the shooting a tragedy, but one that began when Madrid was abused as a child by her father. He says that led her to abuse her own son.
If convicted as a juvenile, the boy can be held until he turns 18.
