PHOENIX (AP) -- A legal challenge to Arizona Corporation Commission rules requiring electric utilities to get a set percentage of their power from renewable sources has itself been renewed.
The Goldwater Institute has filed a new lawsuit challenging the rules with the Arizona Court of Appeals. That action comes after the Arizona Supreme Court declined to consider a similar special-action suit also filed on behalf of utility customers.
The lawsuit alleges the commission exceeded its authority and intruded on the Legislature's policymaking role when it approved the rules.
The commission now has until Nov. 24 to file a response to the new challenge.
