UPDATE: MCSO arrested Fernando Martinez-Cura for unlawfully possessing a 9mm pistol which is the gun the 12-year-old brought to school.
Martinez is the boyfriend of the boy's grandmother and the owner of the firearm.
Martinez is in the United States illegally.
He is currently in jail for felony misconduct involving a weapon and two outstanding warrants.
ORIGINAL: QUEEN CREEK - Just after noon Wednesday the Maricopa County Sheriff's office took a Queen Creek Middle School student into custody for bringing a loaded hand gun to school.
According to the Sheriff's office an employee at the middle school saw the 12-year-old boy showing other students how to load and unload the 9 mm pistol.
The employee immediately took the loaded gun and school officials called MCSO.
According to the sheriff's office they are working with the school to resolve the incident.
MCSO said the boy admitted to bringing the gun to school in his back pack and told deputies he brought the gun to school because another student had been picking on him.
The boy remains in police cutody as the investigation continues.
