UPDATE Sept. 29:

PHOENIX -- Rapper DMX was back in a Valley courtroom Monday morning.

The initial court appearance for DMX was supposed to be last week but was rescheduled.

The judge made sure the rap artist understood that it is required to show up for all his future court hearings.

The next one is set for Oct. 7.

UPDATE Sept. 24:

PHOENIX -- Rapper DMX was, once again, a no-show for his appearance in an Arizona courtroom, but it appears he had a legitimate excuse Tuesday.

His lawyer said DMX, whose real name is Earl Simmons, had a medical problem which was so serious he had to spend Monday night in a Florida hospital. Some reports say he had stroke-related symptoms.

DMX is facing charges in Arizona for allegedly giving false information to hospital staff to get out of paying the bill. He's also facing drug possession, animal cruelty and traffic violations charges.

His court date has been re-scheduled for Sept. 29.


The following press release was sent by the Maricopa County Sheriff's Office:

PHOENIX- Late yesterday, rap-artist Earl Simmons (aka DMX) was extradited to Maricopa County from Miami Dade County, and is in the custody of Sheriff Joe Arpaio's Towers Jail. Simmons is being held in lieu of a $25,000 cash only bond.

Simmons was arrested on a fugitive warrant for failing to appear in Superior Court on theft charges. Simmons has been arrested several times by Maricopa County Sheriff's Office deputies, ranging from criminal traffic violations, animal abuse, felony drug possession, and defrauding the Mayo Clinic of $7500 dollars of hospital services.

August 24, 2007: Maricopa County Sheriff's deputies raided DMX's Cave Creek home and found 12 pit-bulls in poor condition and three others dead. Deputies discovered a cache of weapons and drug paraphernalia. DMX was present during the raid, and was later charged with misdemeanor cruelty to animals, and felony drug charges.

March 2008: Sheriff's deputies arrest DMX for Driving on a Suspended License.

April 2008 : Sheriff's deputies arrest DMX after he attempted to flee deputies on an ATV, and is charged with misdemeanors for failing to pay a park entry fee, destruction of park resources, a firearms violation and driving on a suspended license.

April 2008: Simmons is charged with felony theft of services and identity theft after he checked into the Mayo Hospital using a fictitious name and social security number.

May 2008: A search warrant served on Simmons' residence for the theft of services crime yielded additional drug charges. DMX was taken into custody after barricading himself inside his bedroom. Five pit bull puppies in poor physical condition are seized from the home. Drug charges are pending in this case.

At tax payers' expense, Simmons was extradited to Maricopa County to appear in court.

According to the Sheriff, DMX continues to be a thorn for taxpayers and law enforcement.

"I said it before and I'll say it again, this guy is treating our legal system like a revolving door," says Arpaio. "This is an outrage. Is it because of his notoriety that he is continually released by the courts?

It is about time the revolving door stop and the cell door close."
