PHOENIX (CBS5) -

An Arizona nonprofit has filed a temporary restraining order and preliminary injunction against the state over this week's medical marijuana lottery.

Arizona Organix Inc. claims the Arizona Department of Health Services failed to include them in the selection of the medical marijuana dispensary certificates.

The temporary restraining order was submitted on behalf of William Myer on Monday, the day before the lottery drawings by DHS. Myer was one of the Glendale applicants. [Click here to read the claim (PDF)]

On Tuesday, state officials awarded certificates to nearly 100 people to run medical marijuana dispensaries.

The process was like those used in bingo games, with a machine with air-blown balls randomly selecting winners for districts around the state.

Arizona Organix asked the state for an immediate hearing. It's been scheduled for Aug. 21.
