WASHINGTON (AP) — Constitutional lawyers backing a planned House Republican lawsuit against President Barack Obama say the action is justified because Obama went too far in carrying out his health care law.
Attorneys allied with Democrats in opposing the suit say the GOP has gone too far by pursuing legal action to resolve a political dispute.
The lawyers appeared Wednesday before the House Rules Committee. That panel is considering legislation authorizing the lawsuit that House Speaker John Boehner (BAY'-nur) plans to file.
George Washington University law professor Jonathan Turley told the committee that in unilaterally delaying the health care law's requirement that many employers provide health coverage, Obama has exceeded his power.
Attorney Simon Lazarus of the Constitutional Accountability Center said the Constitution expects presidents to use judgment in carrying out laws.
