 Man who killed officer was an illegal immigrant

PHOENIX -- The man authorities say shot and killed a Phoenix police officer yesterday was an illegal immigrant.

Ben Lemoine and Tess Rafols reports

That new information coming from Immigration and Customs Enforcement today. The agency says 22-year-old Erik Jovani Martinez was in the country illegally last year when he was arrested and convicted on sex charges.

Martinez was then deported, and at some point re-entered the country illegally.

Martinez was killed yesterday after police shot him as he pointed a gun at the head of a carjacking victim.

He had been stopped a little before that for jaywalking by Phoenix police Officer Nick Erfle.

Martinez gave police one of his aliases knowing he had a felony warrant out for his arrest. But the alias he gave also turned up a warrant, and when Erfle tried to arrest Martinez, that's when a fight ensued, the officer was shot and killed and Martinez was chased down and killed, as well.
