SWAT team cleared of wrongdoing in raid that burned down home

By The Associated Press

A Gilbert police SWAT team that burned down the home of an elderly Phoenix couple late last year has been cleared of wrongdoing by internal affairs investigators.

Gilbert police Chief Tim Dorn wrote in a memo that there was only one minor violation of department policy in the December 20th raid, but there was room for improvement.

The homeowners last week filed a notice of claim demanding 750-thousand dollars to settle.

A notice of claim is the initial step in suing a city.

Seventy-three-year-old Salvador Celaya and his wife claim police raided the wrong house.

A manhunt for a home invasion suspect led Gilbert police to a home which caught fire when an officer tossed a diversionary canister through a bedroom window.

But authorities say a truck used in the Scottsdale home invasion was registered to Celaya's daughter, who also lives at the house.
