PHOENIX - Maricopa County's chief deputy is resigning before he can be fired amid an investigation into misconduct.

Sheriff Joe Arpaio issued a termination letter to Chief Deputy Dave Hendershott after a Pinal County investigation accused him of fraud and witness tampering.

But before his final two weeks were up, Hendershott wrote a letter of his own on Wednesday.

In it, he claims the report by Pinal County Sheriff Paul Babeu is "littered with hundreds of flaws, misstates facts and ignores motives and conflicts."

"I am readily prepared to defend these findings,” he went on to say, “However, it is also clear that in the best interest of the sheriff's office, it is time for me to move on in my life with my family."

Deputy Chief Larry Black has also mailed Arpaio a resignation letter.

Both men were scheduled to be fired next week.
