PHOENIX - Prosecutors are seeking the death penalty against the man accused of killing a Phoenix police officer with an assault rifle.

Danny Martinez is charged with first-degree murder and 10 other counts.

Detectives say he gunned down Officer Travis Murphy last month.

"My capitol review committee has reviewed the facts and the circumstances of that case, the aggravating and mitigating factors and they have made a unanimous recommendation from my chief deputy to myself that this office should seek the death penalty in that case."

Officer Murphy leaves behind a wife and two young children including a newborn baby.
