Arizona hearing on English programs resumes Monday

PHOENIX -- A hearing on the adequacy of Arizona's school programs for students learning English resumes Monday in federal court in Tucson.

The judge hearing the case filed on behalf of Nogales Unified School District parents and students heard a fifth day of testimony on Wednesday.

At issue is whether the state meets federal requirements for equal opportunities in education.

The lawsuit was filed in 1992, and it's been in the courts since.

A judge ruled in favor of the plaintiffs in 2000 but the case's posture changed dramatically last year. That was when the U.S. Supreme Court ruled that the state is entitled to a new review based on current circumstances.
