PHOENIX -- A Phoenix business owner is in jail for allegedly selling marijuana illegally.

Police served a search warrant at the Cannabis Spot Vapor Lounge near Dunlap and 43rd avenues Thursday night. Police suspect marijuana was being sold illegally in different forms, including pot-laced candy.

Owner Billy Hayes, 38, was taken into custody. He faces several charges, including possession of a narcotic drug for sale, possession of marijuana for sale and illegal control of an enterprise.

Tom Dean, the attorney for the business, said it is all a misunderstanding and that no marijuana is sold there. He said the business operates as a lounge or gathering spot for medical marijuana patients to socialize and medicate.

Dean said the business has been operating at the location for a year and they haven't had any problems.
