Pushy Eagle American under investigation by Kirby

PHOENIX – You may recall 3 On Your Side profiled Eagle American Kirby Systems earlier this week. 

After that news report aired, I received an email from The Kirby Company headquartered in Ohio stating they were rather upset with Eagle American.

For instance, remember the two-handed shove Gary Harper received from an Eagle American employee.

Not only did we later learn that the aggressive push came from the owner's wife,

but the corporate office spokesperson said it was "upset when it learned of Eagle American's behavior."

The Kirby Company is also upset with what they heard from Ed Rick and other consumers who complained to 3 On Your Side about Eagle American's telemarketing calls.

"I continue to get calls from them. I am on the Do Not Call Registry," Ed explains. He says his telephone rings several times a day and the caller on the other end is none other than Eagle American telling Ed he's won a prize, which is a ploy he says to get him to agree to an in-home Kirby demonstration.

Even though Ed declines the offer, he says the calls continue to jam up his phone every day.

"Obviously they're just blatantly ignoring the laws out there," Ed Rick said.

Eagle American is run by a guy named Don Burkhardt, who's operated several different Kirby distributorships using different business names.

According to documents, the Arizona Attorney General's Office sued the businesses for placing "misleading and deceptive telemarketing calls to consumers," and fined the distributorships $35,000 in civil penalties.  

Consumers like Ed Rick claims Eagle American is up to its old tactics.

A spokesman for Kirby tells me, "The allegations raised in your report were extremely distressing and Kirby intends to conduct a complete investigation of Eagle American's telemarketing practices." 

They went on to say that the company, "...requires distributors of Kirby products to comply with all federal, state, and local laws and to conduct themselves professionally.

Consumers who want to report unwanted and ongoing telemarketing calls from any company are encouraged to file a complaint with the Arizona Attorney General's Office at http://www.azag.gov/consumer/complaintform.html.

They can also file a complaint with the Federal Communication Commission at http://esupport.fcc.gov/complaints.htm.

Finally, don't forget to include all of your telephone numbers on the National “Do Not Call Registry” at https://www.donotcall.gov in order to cut down on the number of telemarketers who contact you.
