FLAGSTAFF, Ariz. (AP) -- Flagstaff Mayor Jerry Nabours says he's giving up on a lawsuit he filed against the city two years ago over sidewalk maintenance after losing a final round in court.
The Arizona Supreme Court upheld a Coconino County judge's decision dismissing his suit on Wednesday.
The Arizona Daily Sun reports that Nabours and his business partner sued after complaining about failing sidewalks adjacent to the apartment complex they co-own.
The city told partner Mike Souris he had 10 days to fix the sidewalk or the city's street department would do the job and bill them for the work.
The men refused to pay and the city placed a lien on the apartment complex.
Nabours was elected mayor in May and says he will continue the fight from inside City Hall.
