NOGALES, Ariz. – Charges were dropped against all three illegal immigrants arrested for the murder of a Border Patrol agent in southern Arizona.

Agent Brian Terry was shot and killed in December while patrolling near Rio Rico about 5 miles north of the Arizona-Mexico border.

The U.S. Attorney’s Office said Tuesday all three of the men have been cleared of involvement in the shooting, saying there was no evidence tying them to the crime.

All three individuals will be deported to Mexico.
