PHOENIX -- A fight at a Phoenix apartment complex has left one teen dead and his two brothers behind bars on aggravated assault charges.

Phoenix Police said they responded to the area of Indian School Road and 17th Street on Saturday night after receiving word of a fight involving shots fired.

Officers arrived to find 18-year-old brothers Merrell and Mardell Curley throwing rocks through the window of an apartment.

Their 17-year-old brother, Theodore Curley, was outside the apartment fatally wounded.

Through their investigation police said they learned that the Curley brothers had been drinking outside at their apartment complex when they began fighting with each other.

During their altercation, a 19-year-old Hispanic man stepped out of his apartment and began arguing with the brothers.

The man wound up going back inside his apartment, but Theodore Curley reportedly went to his apartment and grabbed two knives.

All three Curley brothers went to the man’s apartment, with Theodore trying to forcibly enter the residence.

The man told Theodore he had a gun and that he should leave. Police said the man feared for the safety of his girlfriend and their baby, so he shot Theodore when he didn’t leave their apartment.

Mardell and Merrell were reportedly upset over their brother being shot and began throwing rocks into the man’s apartment. One rock hit the man in the head.

Detectives on the scene questioned and released the man in the apartment. Mardell and Merrell Curley were both arrested and booked into jail on aggravated assault charges.
